NOTICE TO ONLINE CONTESTANTS

In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged, illegible or postage due mail/entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the independent judging organization, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to select winners from among all eligible entries received prior to withdrawal.

Eligibility: The “Back to School” Sweepstakes is open to legal residents of the 50 United States and the District of Columbia age 18 or older at time of entry. Employees of Entertainment Weekly Magazine (the “Sponsor”), Hollywood Video, Movie Gallery, and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible to enter. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.

Entry: Method #1: To enter, visit www.ew.com/backtoschool, and follow all entry instructions to complete and submit the online entry. Online entries must be received between 12:01 AM Eastern Time ("ET") on 8/11/08 and 11:59 PM (ET) on 9/30/08. Online entrants subject to all notices posted online including but not limited to privacy policy. Limit: One online entry per person or email address. In the event of a dispute, online entries will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of entry. “Authorized Account Holder” means the natural person who is assigned to an email address by an internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Method #2: To enter via US mail, mail a postcard with your name and address to: Back to School Sweepstakes, P.O. Box 9238, Medford, NY 11763-9238. Each postcard must be mailed separately. Mail-in entries must be postmarked between 8/11/08 and 9/30/08 and received by 10/7/08. Photocopied, illegible, or mechanically reproduced entries are not eligible. All entries and requests become Sponsor's property and will not be returned or acknowledged. Sponsor is not responsible for lost, late, damaged, misdirected or postage due mail/entries.

Prizes and Approximate Retail Values ("ARV"): One (1) Grand Prize: 4 night/5 day trip for four (4) to British Virgin Islands in Leverick Bay Resort. (ARV: $7,878.00). Actual value of trip depends on location of winner, and airfares at time of departure. Three (3) First Prizes: EW's Best of Family DVD Library consisting of 20 best movies for kids as selected by EW (ARV: $200.00 each); Five (5) Second Prizes: A Snapfish Photo Album (ARV: $50.00 each). Maximum ARV of all prizes: $8,728.00. Odds of winning depend on number of eligible entries received, estimated at 1: 78,000 for the Grand Prize, and 1: 15,600 for a First or 1:26,000 for a Second Prize.

Grand Prize Trip includes: Round-trip coach airfare to/from a major commercial airport closest to winner's primary residence and four consecutive nights hotel accommodations in a two bedroom suite at the Leverick Bay Resort. Grand Prize winner and guests must travel together on dates specified by the Sponsor or forfeit all rights to prize. Grand Prize Winner and guests must travel to/from Puerto Rico and then transfer to an American Eagle flight to/from the British Virgin Islands unless otherwise instructed by Sponsor. Grand Prize does not include airport transfers, meals, hotel incidentals, gratuities, service charges or any other expenses not specified herein, all of which are the responsibility of the winner. Blackout dates including but not limited to all major holidays, and restrictions may apply. A parent or legal guardian must accompany a traveling minor. If Grand Prize is forfeited for any reason whatsoever, and there is sufficient time to notify an alternate winner, the Grand Prize will be awarded to an alternate winner in a separate random drawing from among all non-winning eligible entries. Travel must be completed by 8/31/09, or the Grand Prize Winner will forfeit all rights to his/her prize. Grand Prize winner and guests are responsible for obtaining proper documentation (e.g., passport and valid photo ID) prior to travel. Guests must complete and return a Liability/Publicity Release prior to travel.

Random Drawing: Winners will be selected in a random drawing from all eligible entries received. Random drawing will be conducted on or about 10/14/08 under supervision of Ventura Associates, Inc., an independent judging organization whose decisions are final. Winners will be notified by mail, and the Grand Prize Winner will be required to complete and return an Affidavit of Eligibility and Liability and a Publicity Release (“Affidavit/Release”), if permissible, within 14 days of date specified on notification, or an alternate winner will be selected. Prizes awarded within 30 days after receipt of Affidavit/Release. If Affidavit/Release or prize is returned as undeliverable, it will result in disqualification, and the corresponding prize will be awarded to an alternate winner in a separate random drawing. If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian. Prizes are not redeemable for cash; prizes are non-assignable or transferable except to a surviving spouse. Winners are responsible for all federal, state, local and sales and income taxes (if applicable). Entry and acceptance of any prize constitute permission to use each winner's name, prize won, hometown and likeness for online posting and promotional purposes without further compensation, except where prohibited by law. Limit: one prize per household. All prizes are guaranteed to be awarded.

General: Participating entrants agree to these Official Rules and the decisions of Ventura Associates, Inc. and the Sponsor, and release the Sponsor, Hollywood Video, Movie Gallery, and their affiliated companies, and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation, acceptance and use of each prize. Winners assume all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of any prize.

The winners acknowledge that the Sponsor and all other businesses concerned with this Sweepstakes and their agents do not make, nor are in any manner are responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of any prize except that each merchandise prize shall be subject to its manufacturer’s standard warranty.
